PRIVACY POLICY


1. KEY TERMS

1.1. Company or Data Controller – MB Psmyliu,, a closed joint-stock company established and operating under the laws of the Republic of Lithuania, with legal entity code 305638928, registered office address Osetinų st. 15E, Vilnius, Lithuania.

1.2. Customer or Data Subject – a natural person, a client of the Company (including website visitors), whose personal data is collected by the Company.

1.3. Online Store – the Company’s online store at www.boomtortai.lt

1.4. Services – all the services provided by the Company.

1.5. Personal Data – any information related to a natural person – the Data Subject, whose identity is known or can be directly or indirectly identified by using data such as personal code, one or more physical, physiological, psychological, economic, cultural, or social characteristics of the individual.

1.6. Personal Data Processing – any operation performed on personal data, such as collection, recording, organization, storage, classification, grouping, linking, modification (addition or correction), provision, publication, use, logical and/or arithmetic operations, search, dissemination, destruction, or any other action or set of actions.

1.7. Partner – a legal entity providing services to the Company related to its business activities, selling goods to it, or conducting joint projects with the Company, including but not limited to marketing campaigns, joint sales campaigns, loyalty programs, etc., in media, websites, the Online Store, retail stores, trade networks, etc.

1.8. Cookie – a small piece of text information automatically created when browsing a website and stored on the visitor’s computer or other device.

1.9. Direct Marketing – activities aimed at offering goods or services to individuals by mail, telephone, or other direct means and/or inquiring about their opinions on the offered goods or services.

1.10. Privacy Policy – this document, which defines the principles and rules for the processing of Personal Data when using the Online Store services.

1.11. Account – the primary data for the Customer’s access to the Online Store, consisting of an email address and password.

1.12. Password – a unique combination of numbers, letters, or symbols created by the Customer to access the Online Store.

2. GENERAL PROVISIONS

2.1. The Customer grants the Company the right to perform all Personal Data processing activities within the scope and for the purposes specified in this Privacy Policy.

2.2. Personal data is processed in accordance with the Law on Legal Protection of Personal Data of the Republic of Lithuania and other legal acts regulating the processing and protection of Personal Data, as well as this Privacy Policy.

2.3. Personal data is processed by the Company following the principles outlined below:

2.3.1. Personal data is collected for specific and legitimate purposes;

2.3.2. Personal data is processed accurately, fairly, and lawfully;

2.3.3. Personal data is appropriate, relevant, and limited to what is necessary for the purposes for which it is processed;

2.3.4. Personal data is kept up to date;

2.3.5. Personal data is stored in a form which allows identification of the Data Subject for no longer than necessary for the purposes for which the data was collected and processed;

2.3.6. All information about Personal Data is confidential;

2.3.7. The Customer’s Personal Data and personal information will not be used for unlawful purposes.

2.4. It is assumed that the Customer has read the applicable version of the Privacy Policy and agrees with it when purchasing from the Online Store. If the Customer does not agree with any part of the Privacy Policy, they must not submit an order or purchase goods from the Online Store.

2.5. The Privacy Policy can be reviewed in the Online Store and printed at any time. The Company may change, supplement, or update the Privacy Policy at its discretion. The new version of the Privacy Policy will be published in the Online Store.

2.6. The Customer can place an order in the Online Store without registration, or by registering through their Account.

2.7. During the initial registration in the Online Store via the Account, the Customer must provide their email address, create a secure password, and provide accurate Personal Data to the Online Store. The Customer is responsible for the accuracy of the data. Once the Account is created, the Customer is assigned an identification code.

2.8. When using the Services or making a purchase in the Online Store, the Customer must always provide accurate Personal Data to the Online Store and is responsible for its correctness.

2.9. The Customer has the right to change and update their Personal Data in the Account at any time or request the deletion of the Account.

2.10. The Customer must not disclose the Password to third parties and must keep it secure; otherwise, the Customer assumes all responsibility for any related consequences.

3. COLLECTION, USE, CORRECTION, AND STORAGE OF PERSONAL DATA

3.1. The Company respects every Customer’s right to privacy. The Customer’s Personal Data (e.g., name, surname, email address, phone number, delivery address, age/date of birth, payment details (bank account number, payment method, etc.), purchase history, and, with the Customer’s consent, age, gender, birthdate, residence location) is collected and processed for the following purposes:

3.1.1. E-commerce purposes. The following Personal Data is processed: name, surname, email address, phone number, delivery address, age/date of birth, IP address, payment details. The retention period for Personal Data used for e-commerce purposes is 5 (five) years from the last login to the Online Store.

3.1.2. Direct marketing purposes. The following Personal Data is processed: name, surname, phone number, email address, address, age, gender, birthdate, residence location. The retention period for Personal Data used for direct marketing purposes is 5 (five) years from the last login to the Online Store.

3.2. The Customer may consent to the processing of their Personal Data (e.g., name, surname, phone number, email address, address, age, gender, birthdate, residence location) for direct marketing purposes. If the Customer initially consented to the processing of their data for direct marketing purposes and receiving related communications, they can later withdraw this consent by informing the Company, which will cease processing their Personal Data for direct marketing and stop sending promotional emails.

3.3. The Customer has the right to withdraw consent for the processing of their Personal Data for direct marketing purposes at any time by notifying the Company via email boom@boomtortai.lt.

3.4. The Customer may also opt-out by clicking a link in each direct marketing email to unsubscribe.

3.5. The Customer, as a Data Subject, has the following rights regarding the processing of their Personal Data:

3.5.1. The right to obtain information about the processing of their Personal Data from the Company;

3.5.2. The right to know from where the Personal Data was collected, the purpose of processing, and the recipients of the data;

3.5.3. The right to request corrections, destruction, or suspension of the processing of their Personal Data if the data is being processed unlawfully.

3.6. To exercise their rights, the Customer must present identification documents (passport, ID card, or driver’s license). The Company will provide the Data Subject with information regarding their processed Personal Data once per year at no charge. To exercise their rights under point 3.5, the Customer may contact the Company via email at [EMAIL ADDRESS].

3.7. The Customer’s Personal Data will not be disclosed to third parties except in the following cases:

3.7.1. If the Customer has provided consent, as described in this Privacy Policy;

3.7.2. Personal data for e-commerce purposes may be provided to Partners who provide services related to the Company’s operations;

3.7.3. To competent authorities in accordance with the laws and legal acts of the Republic of Lithuania.

3.8. The Customer is aware of their right to object to the processing of their Personal Data for direct marketing purposes.

3.9. The Customer consents to their Personal Data being shared with Partners involved in fulfilling their order or providing services to the Customer.

3.10. If the Customer does not agree with the Privacy Policy, they will not be able to use the Online Store’s services.

3.11. The Company implements organizational and technical measures to protect Personal Data from accidental or unlawful destruction, alteration, disclosure, or any other unlawful processing.

4. OTHER PROVISIONS

4.1. The Company has the right to modify or amend the Privacy Policy in whole or in part. Any additions or changes to the Privacy Policy will take effect on the day they are published.
